Terms & Conditions

Effective Date: September 20, 2025

1. Definitions

• Service / Application – Recloth mobile application and web service (including shop.recloth.io)
• User – person using Recloth services
• Account – profile created in the Service through Google login
• Content – photos, descriptions and data uploaded by the User
• External platforms – OLX, Allegro and other services integrated with Recloth

2. General provisions

• These terms define the rules for using the Recloth application and services
• Using the Service means accepting these terms
• Polish law applies to matters not regulated herein

3. Registration and Account

• Registration is done exclusively through Google account (OAuth 2.0)
• Minimum user age is 18 years or parental/legal guardian consent
• One person may have one Account
• User is responsible for account security and cannot share it with third parties
• Administrator has the right to suspend or delete an Account in case of terms violation

4. Service usage rules

User may:

• upload photos of their own clothing items
• use AI analysis and create listings
• delete their data and edit analysis results

User may not:

• upload illegal, offensive, pornographic, or violent content
• use the Service to sell stolen or counterfeit items
• bypass security measures, use bots and automated scripts
• overload the system with excessive requests

5. User Content

• Uploaded photos must show real clothing items
• Maximum file size: 10 MB; formats: JPG, PNG, WEBP, HEIC
• User guarantees they have rights to uploaded content
• User bears full responsibility for violating third party rights
• Service does not verify item ownership

6. AI Analysis

• Image analysis is auxiliary in nature
• Results may be inaccurate and require User verification
• Service is not responsible for incorrect classifications or valuations
• Data may be used anonymously to improve AI performance

7. External integrations

• Listing creation follows OLX, Allegro and other platform terms
• Recloth is not responsible for transactions on external platforms
• User can revoke integration authorization at any time
• For Recloth Shop (shop.recloth.io), sales, returns and commission rules are governed by separate shop terms

8. Service Limitations

The service may introduce technical limits to ensure operational stability.

Standard limits:

• maximum 50 analyses per day per user
• maximum 1000 photos in user history
• limitations resulting from external platform APIs (OLX, Allegro)

Administrator reserves the right to change limits or introduce additional restrictions in case of abuse or attempts to circumvent rules. In exceptional situations (e.g., system overload) access to some functions may be temporarily limited.

9. Intellectual property

• User grants the Service a non-exclusive license to process photos for service provision
• Service does not share photos publicly without User consent
• All copyrights to Recloth application and technology belong to Xfaang sp. z o.o.

10. Credits system and payments

Free credits:

• Each new user receives 12 free analysis credits
• One photo analysis = 1 credit
• Free credits are not renewable

Purchasing credits:

• Standard price: 0.50 PLN per 1 credit
• Bulk package (100+ credits): 0.40 PLN per 1 credit
• Minimum purchase amount: 5 PLN

Payment methods:

• Payments processed through Tpay system
• Available methods: payment cards, bank transfers, BLIK, mobile payments
• All transactions are encrypted and secure

Credit usage rules:

• Credits do not expire
• Credits are account-bound and cannot be transferred between users
• If account is deleted, unused credits are forfeited

Right of withdrawal (consumers):

• Consumer has the right to withdraw from the credit purchase agreement within 14 days from the purchase date without giving a reason
• Right of withdrawal expires if the User starts using purchased credits (performs analysis) with express consent and after confirmation of losing the right of withdrawal
• To withdraw from the agreement, send a clear statement to: admin@xfaang.com
• In case of withdrawal, refund will be made within 14 days to the bank account or payment card used for the payment

Complaints:

• Complaints regarding credit purchases can be submitted to: admin@xfaang.com or in writing to: Xfaang sp. z o.o., Sienna 75, 00-833 Warszawa
• Complaint should include: problem description, purchase date, email address associated with the account, and User's request
• Administrator will process the complaint within 14 business days from receipt
• Response to the complaint will be sent to the email address provided in the complaint
• If the complaint is found valid, refund will be made within 14 days from the complaint resolution date

11. Liability

• Service is not responsible for AI valuation accuracy
• Service is not responsible for transactions on external platforms
• Service is not liable for indirect damages or data loss
• User bears full responsibility for content they publish

12. Privacy

• Personal data is processed in accordance with Recloth Privacy Policy
• User has the right to access, edit and delete data

13. Violations and moderation

• Service enables reporting abuse and illegal content
• Violation consequences: warning, account suspension, account deletion
• User has the right to appeal decisions

14. Terms Changes

• Administrator may introduce changes to terms
• User will be informed about significant changes by email
• Non-acceptance of changes means resignation from using the Service

15. Contract Termination

• User can delete Account at any time
• Account deletion results in permanent deletion of all data
• The process is irreversible

16. Final provisions

• Terms are subject to Polish law
• In case of disputes, the court in Warsaw has jurisdiction
